  •  Comment. There are a lot of issues here. The subject is posing in front of a backdrop clearly intended for photography at a public convention. This seems to indicate consent. There are possible derivative work issues with the backdrop (but the background elements may be de minimis). There are also possible issues with the costume. Is this a notable character she is portraying? Is this within scope? Is the portrayal of the character a derivative work?
